The Key Changes made to the Fair Work Act yesterday are:

A Person or entity may apply for an order for the same rates and conditions as the host employer. Further changes made to the Bill include the FWC making an order for multiple employers working at the Host Employer. Note: The Bill ensures that the FWC must carve out service providers
Wage Theft
The introduction of increased jail terms of up to 10 years or fines of 7.8M where underpayments of wages and superannuation are intentional.
Delegates Rights
Rights of Union Delegates to be enshrined in Modern Awards & Enterprise Agreements: The power of Delegates in the workplace have been increased in respect to their ability to represent their union members.
Small Business Exemption on Redundancy
Fixing the issue when a business winds down and gets below 15 employees, the remaining employees have no right to redundancy payments under the NES scale. The changes will now avert this happening, and an employee would be entitled to a redundancy.
